1.1  This is the Privacy Notice of MONPURE Ltd. (Company Number 11565499) whose registered office is at 3 - 8 Bolsover Street, London, England, W1W 6AB (Monpure). Monpure is the controller and responsible for your personal data (collectively referred to as "we", "us" or "our" in this Privacy Notice.

1.3  This Privacy Notice sets out how Monpure. collect and process your personal information when you access and use our site monpure.com(‘our site’). This Privacy Notice also provides certain information that is legally required and lists your rights in relation to your personal data.

1.4  We take our data protection responsibilities very seriously and we comply with all applicable Data Protection Legislation in force from time to time. For the purposes of this Privacy Notice, ‘Data Protection Legislation’ means: the retained EU law version of the General Data Protection Regulation ((EU) 2016/679) (UK GDPR) and the Data Protection Act 2018 (DPA 2018)

We refer to this information throughout this Privacy Notice as ‘personal data’ and section 2 sets out further detail of what this includes. This Privacy Notice is not intended for children and we do not knowingly collect personal data relating to children.

2  The Personal Data We Collect About You

We may collect the following personal data about you:

2.1  Personal data you provide to us via our site, including information that you provide by filling in forms on our site. This includes information provided at the time of registering to use our site and when you make purchases from our site.  This includes:

2.1.1  Identity Data: your name, title and gender;

2.1.2  Contact Data: your billing and delivery postal address, phone, fax and email addresses;

2.1.3  Profile Data: where you have registered with us, your user name and password; and how you heard about us.

2.1.5 Transaction Data: details of transactions you carry out through our site and of the fulfilment of your orders

3.3 Withdrawing your consent

3.3.1  In the event that we rely on your consent, you may at any time withdraw the consent you give to our processing your personal data for those purposes set out in section 3.2.2 above by contacting us at info@monpure.com

3.3.2  If you want to stop receiving future marketing messages and materials at any time, you can do so alternatively by clicking the 'unsubscribe' link which is included in all of our email marketing messages.

3.3.3  Our Cookie Policy sets out how to manage cookies.  

 

3.4  Who receives the personal data you provide to us  

3.4.1  We will share your personal data with the following recipients:

(b) Shopify, Klarna, and PayPal – to process payments made on our site;

(c) Jeju Ltd in relation to social media marketing with our customers;

(d) Emerge PR in relation to press relations and marketing with our customers;

(e) Pack-IT, Mintsoft and DHL and Royal Mail in relation to order fulfilment and delivery services;

(f) Underwater Pistol in relation to SEO, website traffic and online transactions;

(g) Facebook Business in relation to our social customer audience segments;

(h) Gorgias in relation to customer support software;

(i) Angellist and Indeed in relation to recruitment;

(j) Xero, Ignition Financial and Husky Finance for finance purposes;

(k) Shopify and its various application programming interfaces (APIs) for management of our company and customer data;

(l) Borderfree Inc. in relation to international shipping (selected countries);

(m) Use of first party data (cookie data, email addresses) to build remarketing audiences on Google Adwords and Bing;

(n) Use of first party data (cookie data, email addresses) to build custom audiences for targeting on Facebook and Instagram;

(o) HMRC, legal and other regulators or authorities, including those who request your personal data or to report any potential or actual breach of applicable law or regulation;

(p) external professional advisers such as accountants, bankers, insurers, auditors and lawyers; law enforcement agencies, courts or other relevant party, to the extent necessary for the establishment, exercise or defence of legal rights; and

(q) third parties where necessary for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties.

However, we do not forward personal data to these third parties for any promotional purposes by those companies.

3.4.2  In addition, we may disclose the personal data you provide to us to our group companies or any third party data processors other than those listed above who may process data on our behalf for the purposes set out in section 3.5 above.

3.4.3  We may also disclose your personal information to other third parties in order to undertake any of the activities listed in sections 3.3. and 3.5.

3.5 Transfers of your personal data to other countries  

3.5.1  The personal data we collect from you is currently held within the UK.  However, it is possible that in the future such personal data may be transferred, stored and/or processed outside the UK. Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

(a) We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data.

(b) Where we use certain service providers, we may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

3.6 How long we will hold your personal data for

3.6.1  We will only hold your personal data for so long as is reasonably necessary for us to do so, in accordance with the following criteria:

(a) the on-going business operation / relationship that we have with you;

(b) the completion of the purpose for which the personal data was given;

(c) our legal obligations in relation to that personal data and other legal requirements;

(d) the type and size of the data held and whether any of it is deemed to be special category personal data; or

(e) our accounting requirements in relation to that personal data.

We keep the length of time that we hold your personal data for under review.

Where we no longer need to process your personal data for the purposes set out in this Privacy Notice then we will delete your personal data from our system.  

3.7  Where we store your personal data

3.7.1  All information you provide to us is stored on our secure servers.

3.7.2  We will keep your information secure by taking appropriate technical and organisational measures against its unauthorised or unlawful processing and against its accidental loss, destruction or damage.

3.7.3  Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

3.7.4 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site. Any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

3.7.5  Payment transactions are made using payments providers. All credit/debit card transactions on our site are processed using, a secure online payment gateway that encrypts your card details and cannot be accessed by us. 

3.8  Accuracy of your personal information

It is important that the personal data we hold about you is accurate and current and we take all reasonable precautions to ensure that this is the case but we do not undertake to check or verify the accuracy of personal data provided by you.  Please keep us informed if your personal data changes during your relationship with us either by logging onto your account on the website or by contacting us. We will not be responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide to us.

3.9  Opting out

You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you.

Where you opt out of receiving marketing messages, this will not apply to personal data provided to us as a result of a product purchase, warranty registration, product/service experience or other transactions.

Your Legal Rights

Request access to your personal data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

  • If you want us to establish the data's accuracy.
  • Where our use of the data is unlawful but you do not want us to erase it.
  • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
